COPTIC MEET LLC End User License Agreement (EULA)

COPTIC MEET App End User License Agreement

This End User License Agreement (“Agreement”) is between you and COPTIC MEET and governs use of this app made available through the Apple App Store. By installing the COPTIC MEET App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the COPTIC MEET App.

In order to ensure COPTIC MEET provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the "Report as offensive" feature found under each post.

1. PARTIES:

This Agreement is between you and COPTIC MEET only, and not Apple, Inc. (“Apple”). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. COPTIC MEET, not Apple, is solely responsible for the COPTIC MEET App and its content.

2. PRIVACY:

COPTIC MEET may collect and use information about your usage of the COPTIC MEET App, including certain types of information from and about your device. COPTIC MEET may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the COPTIC MEET App.

COPTIC MEET implements industry-standard security measures, including encryption, to protect user data. However, no system is entirely secure, and users should take necessary precautions when sharing personal information within the app. For more details on data collection, storage, and user rights, please refer to the Privacy Policy.

3. LIMITED LICENSE:

COPTIC MEET grants you a limited, non-exclusive, non-transferable, revocable license to use the COPTIC MEET App for your personal, non-commercial purposes. You may only use the COPTIC MEET App on Apple devices that you own or control and as permitted by the App Store Terms of Service.

You agree not to:

Distribute, lease, or rent the app or any of its content to any third party.
Modify, decompile, reverse engineer, or attempt to extract the source code of the app.
Bypass or attempt to bypass any security feature implemented in the app.
Use the app to engage in any fraudulent, illegal, or unauthorized activities.

4. AGE RESTRICTIONS:

By using the COPTIC MEET App, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the COPTIC MEET App does not violate any applicable law or regulation. Your access to the COPTIC MEET App may be terminated without warning if COPTIC MEET believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child's use of the COPTIC MEET App, you agree to be bound by this Agreement in respect to your child's use of the COPTIC MEET App.

5. OBJECTIONABLE CONTENT AND USER MODERATION:

Content may not be submitted to COPTIC MEET, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any Objectionable Content.

Users acknowledge that they are solely responsible for the content they share, and COPTIC MEET reserves the right to remove content at its sole discretion, even if it does not explicitly violate the outlined content policies.

Objectionable Content includes, but is not limited to:
(i) sexually explicit materials;
(ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity;
(iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent;
(iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and
(v) gambling, including without limitation, any online casino, sports books, bingo or poker.

Consequences for Violation:
Users who submit objectionable content will face immediate removal of their content and may be subject to account suspension, or permanent ban in the event of repeat offenses. Users can report objectionable content via the "Report as offensive" button, and each report will be reviewed promptly by COPTIC MEET moderators.

Blocking Abusive Users:
Users who experience abusive behavior may block the offending user directly via the app. The blocked user will no longer be able to interact with the reporting user. COPTIC MEET encourages users to block abusive individuals and report them for further investigation.

Enforcement Process:
COPTIC MEET employs a rigorous content moderation process. All flagged content is reviewed by a moderator, and any violations will result in immediate action. COPTIC MEET reserves the right to take further action, including suspending or terminating accounts that repeatedly violate the Terms of Service.

6. WARRANTY:

COPTIC MEET disclaims all warranties about the COPTIC MEET App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, COPTIC MEET, not Apple, shall be solely responsible for such warranty.

ACKNOWLEDGMENTS AND WARRANTY LIMITATIONS:
The User acknowledges that complex mobile applications are never completely free from defects, errors, and bugs; and subject to the other provisions of this EULA, COPTIC MEET gives no warranty or representation that the Mobile application will be completely free from defects, errors, and bugs.
The User acknowledges that complex mobile applications are never entirely free from security vulnerabilities; and subject to the other provisions of this EULA, COPTIC MEET gives no warranty or representation that the Mobile application will be entirely secure.

The User acknowledges that the Mobile application is only designed to be compatible with that mobile application specified as compatible in the Mobile application Specification; and COPTIC MEET does not warrant or represent that the Mobile application will be compatible with any other mobile application.

The User acknowledges that COPTIC MEET will not provide any legal, financial, accountancy, or taxation advice under this EULA or in relation to the Mobile application; and, except to the extent expressly provided otherwise in this EULA, COPTIC MEET does not warrant or represent that the Mobile application or the use of the Mobile application by the User will not give rise to any legal liability on the part of the User or any other person.

7. MAINTENANCE AND SUPPORT:

COPTIC MEET strives to provide support and moderation to ensure a safe, secure, and pleasant experience for all users.

However, COPTIC MEET does not guarantee uninterrupted access to the app and is not responsible for any disruptions, downtime, or data loss that may occur due to system maintenance, third-party services, or other unforeseen circumstances.

8. PRODUCT CLAIMS:

COPTIC MEET, not Apple, is responsible for addressing any claims by you relating to the COPTIC MEET App or use of it, including, but not limited to:
(i) any product liability claim;
(ii) any claim that the COPTIC MEET App fails to conform to any applicable legal or regulatory requirement; and
(iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.

9. THIRD-PARTY SERVICES AND LINKS:

COPTIC MEET may include links to third-party websites or services within the app. Users acknowledge that COPTIC MEET is not responsible for the privacy practices, security, or content of third-party services and that use of such services is at their own risk.

10. THIRD PARTY INTELLECTUAL PROPERTY CLAIMS:

COPTIC MEET shall not be obligated to indemnify or defend you with respect to any third-party claim arising out or relating to the COPTIC MEET App. To the extent COPTIC MEET is required to provide indemnification by applicable law, COPTIC MEET, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any claim that the COPTIC MEET App or your use of it infringes any third-party intellectual property right.

No Assignment of Intellectual Property Rights:
Nothing in this EULA shall operate to assign or transfer any Intellectual Property Rights from COPTIC MEET to the User, or from the User to the Licensor.

11. SOURCE CODE:

Nothing in this EULA shall give to the User or any other person any right to access or use the Source Code or constitute any license of the Source Code.

12. CHARGES:

The User shall pay the Charges to COPTIC MEET in accordance with this EULA. All amounts stated in or in relation to this EULA are, unless the context requires otherwise stated. Applicable value-added taxes will be added to those amounts and payable by the User to the Licensor.

13. PAYMENTS:

COPTIC MEET shall issue invoices for the Charges to the User. The User must pay the Charges to the Licensor by debit card or credit card.

All transactions are final, and refunds will only be issued at COPTIC MEET’s discretion, in accordance with our Refund Policy. If a user disputes a charge, they must contact COPTIC MEET within 30 days of the transaction date.

14. TERMINATION AND ACCOUNT DELETION:

COPTIC MEET may terminate this EULA. Upon the termination of this EULA, all of the provisions of this EULA shall cease to have effect, save that the following provisions of this EULA shall survive and continue to have effect in accordance with express terms or otherwise indefinitely. Except to the extent that this EULA expressly provides otherwise, the termination of this EULA shall not affect the accrued rights of either party.

Users may request account deletion at any time through the app’s settings or by contacting customer support. Upon deletion, user data may be retained for legal compliance or security purposes as outlined in our Privacy Policy.

15. DISPUTE RESOLUTION & WAIVER OF LEGAL ACTION:

By using the COPTIC MEET App, you agree that any disputes, claims, or controversies arising out of or relating to your use of the COPTIC MEET App shall be resolved exclusively through negotiation with COPTIC MEET's support team. You expressly waive any right to initiate or participate in any lawsuit, arbitration, or class action against COPTIC MEET LLC, its affiliates, officers, directors, or employees.

To the fullest extent permitted by law, all claims must be resolved on an individual basis, and you agree not to bring any claim as a plaintiff or class member in any purported class, consolidated, or representative proceeding. This waiver applies to all forms of legal action, including but not limited to personal injury claims, contract disputes, statutory violations, and any claims related to app usage or content.

BY ACCEPTING THIS AGREEMENT AND USING THE COPTIC MEET APP, YOU UNDERSTAND AND AGREE THAT YOU ARE GIVING UP YOUR RIGHT TO SUE OR SEEK REMEDIES IN COURT OR THROUGH ARBITRATION. THIS INCLUDES WAIVING THE RIGHT TO A TRIAL BY JURY AND PARTICIPATION IN ANY CLASS ACTION LAWSUIT.

If you do not agree to these terms, you must discontinue use of the app and delete your account immediately.

If any portion of this clause is deemed unenforceable, the remaining provisions shall continue in full effect.

16. CHANGES TO THIS AGREEMENT:

COPTIC MEET reserves the right to modify this Agreement at any time. Users will be notified of any material changes via email or an in-app notification. Continued use of the app after modifications take effect constitutes acceptance of the revised Agreement.

17. GOVERNING LAW:

This Agreement shall be governed and construed in accordance with the laws of the jurisdiction in which COPTIC MEET LLC is registered, without regard to its conflict of law provisions.

Definitions:
"Effective Date": The date upon which the User gives their express consent to this EULA, following the issue of this EULA by the Licensor.
"Force Majeure Event": An event, or a series of related events, that is outside the reasonable control of the party affected.
"Intellectual Property Rights": All intellectual property rights wherever in the world, including any COPTIC MEET application or right of application for such rights.
"Mobile Application": COPTIC MEET.
"Source Code": COPTIC MEET Mobile application code.
